New contributions for the for the online commentary on the constitution

verfassung.li, the online commentary on the Liechtenstein Constitution published by the Liechtenstein Institute, has been supplemented by three further commentaries. Peter Bussjäger comments on Art. 32 LV, which is summarized as a fundamental right of privacy and secrecy, as very different aspects fall within its scope of protection. Cyrus Beck's commentary on Art. 41 LV concerns the right of association and assembly and thus also the permissibility of demonstrations. Patricia Schiess comments on Art. 44 LV, which regulates compulsory military service.

Art. 32 LV guarantees the freedom of the person, the right of domicile and the secrecy of correspondence and documents. The protection of privacy and data protection are also derived from Art. 32 LV. When commenting on this constitutional provision and the provision of Art. 41 LV on freedom of association and the right of assembly, the relevant case law of the ECtHR on Art. 5, Art. 8 and Art. 11 ECHR is considered in detail.

As the topics of security and defense are not addressed in any other constitutional provision, the commentary on Art. 44 LV also contains explanations on these two current topics.

The commentaries on Art. 52, Art. 63 and Art. 78 LV have also been updated. All laws and ordinances cited in these three commentaries are now up to date as of summer 2024. In particular, this means that the comments on data protection law are now up to date again.
